The EB-2 category includes two distinct classifications of aliens: (1) Aliens who are members of professions holding advanced degrees or their equivalent and, (2) aliens who because of their exceptional ability in the sciences, art or business will substantially benefit the national economy, cultural or educational interests or the welfare of the United States.
The employment based third preference category is utilized for professionals as well as skilled and other foreign workers. In order to qualify for this category, professionals are generally required to hold a U.S. baccalaureate degree or a foreign equivalent degree. In this category, experience and/or education may not be substituted for such a degree. Under this preference category, all Petitions mandate a permanent, full time job offer as well as a labor certification.
